Terms of Service

These Terms of Service ("Terms") govern your use of dbio.ai ("Platform", "we", "us", "our") operated by dbio.ai. By accessing or using our Platform, you agree to be bound by these Terms.

1. Account Registration

To use certain features, you must create an account. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use

You must be at least 18 years old (or the legal age in your jurisdiction) to create an account.

2. Services

dbio.ai provides:

  • Website Builder: Tools to create bio pages, landing pages, portfolios, blogs, and online stores
  • Hosting: Cloud hosting on Cloudflare's global network
  • Custom Domains: Domain registration and connection services
  • Commerce: Payment processing, order management, and digital storefront features
  • AI Tools: AI-powered content generation and design assistance
  • MCP Server: API access for AI-assisted management

3. User Content

You retain ownership of all content you create, upload, or publish on the Platform ("User Content"). By using our services, you grant us a non-exclusive, worldwide, royalty-free license to host, display, and distribute your User Content solely for the purpose of operating the Platform.

You are solely responsible for your User Content and represent that:

  • You own or have the necessary rights to use and share the content
  • Your content does not violate any third party's intellectual property or privacy rights
  • Your content complies with all applicable laws and regulations
  • Your content does not violate our Acceptable Use Policy

4. Acceptable Use

You agree not to use the Platform to:

  • Publish illegal, harmful, threatening, abusive, or defamatory content
  • Sell counterfeit goods, illegal substances, or prohibited items
  • Distribute malware, viruses, or harmful code
  • Engage in fraud, phishing, or deceptive practices
  • Violate intellectual property rights of others
  • Send spam or unsolicited communications
  • Attempt to gain unauthorized access to the Platform or other users' accounts
  • Use the Platform for any purpose that violates applicable laws

We reserve the right to suspend or terminate accounts that violate these terms, with or without notice.

5. Stores and Commerce

If you create an online store on the Platform:

  • You are the merchant of record for all transactions in your store
  • You are responsible for fulfilling orders, handling returns, and customer service
  • You must comply with all applicable consumer protection and e-commerce laws
  • You must accurately represent your products and services
  • You must maintain appropriate tax compliance for your jurisdiction

dbio.ai is not a party to transactions between you and your customers. We provide the platform and payment processing tools, but the contractual relationship is between you and your buyer.

6. Payments and Billing

  • Wallet System: You may deposit funds into your dbio.ai wallet to purchase stores, domains, and premium features
  • Deposits: All deposits are processed via Stripe and are non-refundable except as required by law
  • Pricing: Prices are displayed in USD. We may change pricing with 30 days' notice
  • Domain Purchases: Domain registrations are subject to the terms of the domain registrar (Name.com)
  • Payment Processing Fees: Transaction fees apply as specified in your plan

7. Custom Domains

When you connect or purchase a custom domain through dbio.ai:

  • DNS management is handled through Cloudflare
  • SSL certificates are automatically provisioned
  • You are responsible for maintaining domain registration renewals
  • Domain transfers are subject to ICANN policies

8. Intellectual Property

The Platform, including its design, features, code, and documentation, is owned by dbio.ai and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Platform.

Templates, themes, and AI-generated content provided by the Platform are licensed for use within your dbio.ai projects. You may not resell or redistribute them separately.

9. Content Moderation

We reserve the right to review, moderate, and remove User Content that violates these Terms or our Acceptable Use Policy. We may:

  • Remove or disable content that we determine is unlawful or violates our policies
  • Suspend or terminate accounts for repeated violations
  • Cooperate with law enforcement when required by law
  • Respond to valid DMCA takedown requests

10. Store Transfers

You may transfer ownership of your store to another dbio.ai user. Both parties must agree to the transfer. Transferred stores retain their content, and the new owner assumes all responsibilities.

11. Termination

You may close your account at any time. We may suspend or terminate your account if:

  • You violate these Terms or our Acceptable Use Policy
  • Your account is inactive for an extended period
  • We are required to do so by law

Upon termination, your right to use the Platform ceases immediately. We may retain your data for a reasonable period for legal and operational purposes.

12. Disclaimer of Warranties

The Platform is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the Platform will be uninterrupted, error-free, or secure.

13. Limitation of Liability

To the maximum extent permitted by law, dbio.ai shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Platform.

Our total liability shall not exceed the amount you paid to dbio.ai in the 12 months preceding the claim.

14. Indemnification

You agree to indemnify and hold harmless dbio.ai, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Platform, your User Content, or your violation of these Terms.

15. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes via email or a notice on the Platform. Continued use of the Platform after changes constitutes acceptance of the updated Terms.

16. Governing Law

These Terms are governed by the laws of the jurisdiction in which dbio.ai operates. Any disputes shall be resolved through binding arbitration or in the courts of the applicable jurisdiction.
